Privacy Notice
The protection of your personal data is particularly important to Mag. Mgr. Lucia Holländer, LL.M., Attorney-at-Law (“holländer law”, “we”, “us”). We comply strictly with the legal provisions of the EU General Data Protection Regulation, the Austrian Data Protection Act and all other applicable laws governing the protection, lawful handling and confidentiality of personal data. Below we inform you about the processing of your data when you visit and use this website.
1. Personal data
Personal data includes all information relating to an identified or identifiable natural person, e.g. name, address, email address, telephone number, date of birth, age, gender, social security number as well as photos, video or voice recordings. Sensitive data such as health data or data relating to criminal proceedings may also be covered.
2. Right of access and deletion
As a client – and generally as a data subject – you have the right at any time (subject to the attorney’s duty of confidentiality) to obtain information on your stored personal data, their origin, recipients and the purpose of processing. You also have the right to rectification, data portability, objection, restriction of processing as well as the blocking or deletion of incorrect or unlawfully processed data.
Please inform us of any changes to your personal data.
You may withdraw any consent you have given for the use of your personal data at any time. Requests for access, deletion, rectification, objection and/or data portability (where this does not cause disproportionate effort) may be addressed to the postal address specified in section 11.
If you believe that the processing of your personal data by holländer law infringes applicable data protection law or your rights have otherwise been violated, you may lodge a complaint with the competent supervisory authority. In Austria this is the Austrian Data Protection Authority.
3. Data security
We protect your personal data through appropriate organisational and technical measures to guard against unauthorised, unlawful or accidental access, processing, loss, use and manipulation. Despite our efforts to maintain a high level of diligence, it cannot be ruled out that information transmitted via the internet may be viewed and used by third parties.
Please note that we therefore assume no liability for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacking of email accounts, interception of telephone/fax messages).
4. Use of data
We will not process the data made available to us for purposes other than those covered by the engagement agreement or your consent or otherwise permitted by the GDPR. An exception applies to anonymised use for statistical purposes.
5. Transfer of data to third parties
To fulfil your mandate it may be necessary to transfer your data to third parties (e.g. opposing parties, substitutes, insurers, service providers, courts or authorities). Such transfer takes place solely on the basis of the GDPR – in particular to perform the mandate or with your prior consent.
We also point out that, in the course of legal representation, factual and case-related information about you is regularly obtained from third parties.
Some of the recipients mentioned above may be located outside your country or process your personal data there. The level of data protection in other countries may not be equivalent to that in Austria. We transfer personal data only to countries for which the European Commission has decided that they provide an adequate level of protection or we ensure appropriate safeguards, e.g. by concluding standard contractual clauses (2010/87/EC and/or 2004/915/EC).
6. Notification of data breaches
We strive to ensure that data breaches are detected early and, where necessary, reported to you and/or the competent supervisory authority without undue delay, including the categories of data concerned.
7. Retention of data
We will not retain data for longer than is necessary to fulfil our contractual or legal obligations and to defend against potential liability claims.
8. Server log files
To optimise this website in terms of system performance, user-friendliness and provision of useful information about our services, we automatically collect and store information in so-called server log files that your browser transmits to us. This includes your IP address, browser and language settings, operating system, referrer URL, internet service provider and the date/time of your visit.
This data is not merged with other personal data sources.
9. Cookies
This website uses “cookies” to make our offering more user-friendly, effective and secure.
A “cookie” is a small text file sent from our web server to your browser’s cookie file on your device. It enables the website to recognise you when a connection between our web server and your browser is established. Cookies help us determine how frequently our webpages are used and by how many users.
